N-[1-Benzyl-4-piperidyl]-N-phenylpropanamide (Benzylfentanyl) its optical and geometric isomers, salts and salts of isomers
This substance remained “scheduled” even though the legal authorization that placed it here (50 FR 43698) had expired decades earlier. After a quarter of a century, 75 FR 37300 ultimately banishes it.
Effective 13 Jan 2011, 76 FR 2287 corrected the prior notice of proposed scheduling, 75 FR 71635, by striking out parts addressing the Regulatory Flexibility Act and the Congressional Review Act on the grounds that neither Act applies to the proposal and are therefore immaterial.
While 75 FR 71635 proposed to add only five substances to Schedule I, final rule 76 FR 11075 casts the net rather wider, scheduling the original five and “…the optical, positional, and geometric isomers, salts and salts of isomers” of each. The final rule is silent about this incongruity.

On 24 Nov 2010, 75 FR 71635 proposed to add, for one years’ duration, via the emergency scheduling provision of 21 USC 811(h):
1-Butyl-3-(1-naphthoyl)indole (JWH-073), its optical, positional, and geometric isomers, salts and salts of isomers
While 75 FR 71635 proposed to add only five substances to Schedule I, final rule 76 FR 11075 casts the net rather wider, scheduling the original five and “…the optical, positional, and geometric isomers, salts and salts of isomers” of each. The final rule is silent about this incongruity.
