Effective 13 Jan 2011, 76 FR 2287 corrected the prior notice of proposed scheduling, 75 FR 71635, by striking out parts addressing the Regulatory Flexibility Act and the Congressional Review Act on the grounds that neither Act applies to the proposal and are therefore immaterial.
While 75 FR 71635 proposed to add only five substances to Schedule I, final rule 76 FR 11075 casts the net rather wider, scheduling the original five and “…the optical, positional, and geometric isomers, salts and salts of isomers” of each. The final rule is silent about this incongruity.
